Negligence -- res ipsa loquitur -- application of doctrine. 1. To give rise to res ipsa loquitur it must appear, among other things, that the instrumentality inflicting the injury was under the control of the defendant. Where there is dispute as to this factor, it is proper for the court to submit this issue to the jury under instructions such that if they find defendant to be in control of the instrumentality then they may apply res ipsa loquitur; otherwise not.
